Carrie Fitness Membership Terms

By purchasing or using a Carrie Fitness Membership, you agree to the following terms and conditions, which supplement and form a part of the Carrie Fitness Terms of Service. Capitalized terms not defined here have the meaning given to them in the Carrie Fitness Terms of Service.

A “Member” is any individual with a Carrie Fitness subscription, for personal, non-commercial use. A “Membership Holder” is any Member who activates and pays the monthly subscription fees for a Membership, including any individual who pays the monthly subscription fees for a Membership with a prepaid, gift, or promotional activation code (“Activation Code”). A “Membership” is one of the Membership Tiers as defined below.

Membership Tiers 

Membership Tiers. Memberships are sold as one of the Membership Tiers, currently “Feel Good,” “Feel Great” and “Feel Amazing,” each of which provide the Membership Holder with the respective content, features and benefits and as described below, subject to the respective pricing, fees, limitations and restrictions, as we may update or amend from time to time by posting notice on the Website or amending these Membership Terms, and otherwise subject to the terms and conditions in the Terms of Service (the “Tiers”):

  • The Carrie Fitness Workout Library (the “Library”) is the core repository for all Carrie Fitness Workouts (“Workouts”) and Workout video access for Members. The Library is continually expanding as new videos and other content are posted to the Library. All Membership Holders may access the Library by logging in to the Membership Holder’s account on the Website, but some content in the Library is only accessible to certain Tiers.
  • NEW On-Demand Workouts are typically released weekly and posted to the Library, spanning all Workout categories and generally ranging from 15 minutes to 45+ minutes.
  • NEW On-Demand Weekly Express Workouts are 10-minute Workouts focused on a specific area of the body or a piece of equipment. Express Workouts are typically released and posted to the Library weekly and are intended to be completed 2-3 times during the week to complement the Carrie Fitness LIVE and On-Demand Workouts, as available in a Membership Holder’s Tier.
  • NEW LIVE Workouts are real-time live-streamed Workouts with Carrie, typically occurring weekly on a schedule made available to qualifying Membership Holders. LIVE Workouts generally average 35 minutes, spanning all Workout categories on a rotating basis. Qualifying Membership Holders may participate in LIVE Workouts by logging into the Membership Holder’s account on the Website before a scheduled LIVE Workout and accessing the LIVE Workout stream at the scheduled time.
  • Previously Recorded LIVE Workouts are recorded, fully edited versions of the weekly LIVE Workouts, made available in the Library to qualifying Membership Holders. New Previously Recorded LIVE Workouts are typically posted to the Library the same day a Carrie LIVE Workout occurs.
  • Workout Bundles are a connected series of 5-7 Express Workouts targeting a specific area of the body or workout category, released by Carrie Fitness from time to time. Workout Bundles are made available in the Library to qualifying Membership Holders.
  • Challenges are Workout regimens that can be incorporated into a Membership Holder’s fitness plan, keeping things fun and fresh. Each Challenge takes 7 days to 30 days to complete and has a particular theme. Challenges are typically released by Carrie Fitness several times per year and made available in the Library to qualifying Membership Holders.
  • Bonus Workouts are unscheduled On-Demand and LIVE Workouts, made available from time to time to qualifying Membership Holders in addition to the scheduled On-Demand and LIVE Workouts. Qualifying Membership Holders will be notified when a new Bonus On-Demand Workout is posted in the Library. Membership Holders in a Tier qualifying for Bonus LIVE Workouts will receive a notification that a Bonus Live Workout will occur approximately 24 hours in advance. As with other LIVE Workouts, qualifying Membership Holders may participate in Bonus LIVE Workouts by logging into the Membership Holder’s account on the Website in advance of the time designated in the notification for the Bonus LIVE Workout and accessing the Bonus LIVE Workout stream at the specified time.
  • The Newsletter contains a wide range of engaging fitness and lifestyle content crafted to motivate and stimulate Carrie Fitness Members. New Newsletters are typically released every 1-3 months and made available to qualifying Members via email and posted in the Library.

As a Membership Holder, you may possess one or more Memberships at one of the Tiers. We may restrict the number of streams that can occur simultaneously under a single Membership or the maximum number of users per Membership. The Membership Holder is responsible for all activities under their Membership.

Billing Cycles, Offers and Activation Codes

Billing Cycles and Auto-Renewal. Any Membership recurs on a monthly (“Monthly Cycle”) or annual basis (“Annual Cycle,” together with the Monthly Cycle each period a “Cycle”), as applicable, until it is canceled in accordance with these Membership Terms. The Membership fees for each Membership Tier are below (“Membership Fees”):

Billing occurs at the beginning of the Cycle, after which, (a) a Monthly Cycle provides access for one month, or (b) an Annual Cycle provides access for one year, as applicable. By purchasing a Membership, you acknowledge that your Membership has recurring payment features for the Membership Fees and accept responsibility for all recurring payment obligations before the cancellation of your Membership by you or Carrie Fitness. To change or terminate your Membership, go to your account settings or contact us.

Other Offers. Carrie Fitness may offer additional promotions or discounts related to Memberships from time to time. Please read the details of those offers carefully, as any additional terms presented during the signup process will form part of these Membership Terms. Unless specified in writing, all discount offers that require payment are non-refundable (including but not limited to annual Carrie Fitness subscriptions). Any trial or other promotion must be used within the specified time frame of the trial or promotion. You may be required to have a valid payment method on file to initiate a trial; in this case, if you do not cancel before your trial period ends, your account will be converted to a paid Membership and charged per these Membership Terms.

Prepaid, Gift, and Promotional Activation Codes. You may be given the opportunity to prepay for a period of one or more Cycles of your Membership, or your Membership may have been paid for with an Activation Code with a set prepaid period at the time of Membership activation. At the conclusion of a prepaid period, unless you cancel prior to renewal and to the extent permitted by applicable law, your Membership will automatically continue on a Monthly Cycle basis at the then-existing non-promotional price for your Membership. A Member who activates a Membership with an Activation Code will be required to complete Account Registration (as provided below), provide all required information, including up-to-date billing information at the time of activation, and otherwise comply with the Carrie Fitness Terms of Service, including these Membership Terms. Failure to provide all required Account Registration information will prevent you from successfully activating your Membership or using your Activation Code. Activation Codes have no cash value, even if tied to a set prepaid Membership period. Activation Codes have no property value. Activation Codes cannot be purchased or sold, redeemed for cash or credit or any other monetary value or currency, or used to pay debts. Activation Codes may not be assigned, transferred, traded, or pledged to any third party by the recipient except as may be expressly authorized by Carrie Fitness. Activation Codes cannot be transferred by operation of law, such as by inheritance, in bankruptcy, or in connection with a divorce. Activation Codes that are sold, transferred, or assigned may be rescinded, voided, or confiscated at Carrie Fitness’s discretion. Activation Codes are available only to the designated recipient at the time of issuance of the Activation Code and only if the recipient completes Account Registration and otherwise consents to and complies with the Carrie Fitness Terms of Service, including these Membership Terms. Carrie Fitness will decide disputes as to the owner of the Activation Code in its sole and absolute discretion.

Account Registration

Account Registration. You can register by successfully completing a Carrie Fitness purchase, including with an Activation Code, or by creating an account on the Carrie Fitness Site or an App, as further described in our Terms of Service. All information you provide must be accurate, including your name, address, credit, debit, or charge card numbers, expiration dates, and any other payment information. You are responsible for keeping such information up-to-date and must provide changes promptly to your account page, which may be accessed through the Carrie Fitness Site. Carrie Fitness’s use of your information is governed by our Privacy Policy. YOU MUST PROMPTLY NOTIFY US OR OUR PAYMENT PROCESSORS IF YOUR PAYMENT METHOD IS CANCELED (E.G., FOR LOSS OR THEFT) OR IF YOU BECOME AWARE OF A POTENTIAL BREACH OF SECURITY, SUCH AS THE UNAUTHORIZED DISCLOSURE OR USE OF YOUR USERNAME OR PASSWORD.

Any individual who creates an account on the Carrie Fitness App but does not purchase a Membership and is not included under the account of a Membership Holder shall comply with Carrie Fitness’s Terms of Service as if they were a “Member” under such agreements and is subject to the Suspension/Termination by Carrie Fitness section below as if they were a “Member.”

Change, Termination or Cancellation of Subscription

Changing Membership Tier. You may modify your Membership in the middle of a Cycle by upgrading your Membership from a lower priced Tier to a higher priced Tier by you paying the difference in the Membership Fees between the lower priced Tier and the higher priced Tier for the pro rata portion time remaining on your then-current Cycle. You may also modify your Membership in the middle of a Cycle by downgrading your Membership from a higher priced Tier to a lower priced Tier, and we will refund you the difference in the Membership Fees between the higher priced Tier and the lower priced Tier for the pro rata portion time remaining on your then-current Cycle.

Cancellation of Membership. If you cancel your Membership on an Annual Cycle, you will no longer be able to use your Membership as of the date of cancellation and we will refund you an amount equal to fifty percent (50%) of the Membership Fees for the pro rata portion time remaining on your then-current Cycle. For example, if you have an Annual Cycle Membership on the Feel Amazing Tier and you cancel the Membership with six months remaining on the Cycle, you would receive a refund for 50% of the remaining pro rata portion of the Feel Amazing Tier Membership Fees for the remaining six months of the Cycle in the amount of $135. If you cancel your Membership on a Monthly Cycle, you may use your Membership until the end of the then-current Cycle, and your Membership will not be renewed after that Cycle. However, you will not be eligible for a pro rata refund of any portion of the Monthly Cycle Membership Fees paid for the then-current Cycle.

Suspension/Termination by Carrie Fitness. Carrie Fitness may immediately terminate or suspend your account and all or a portion of your Membership or your access to the Carrie Fitness Site or App without notice if:

  1. your payment is overdue (provided that we will use reasonable efforts to notify you of the overdue payment before we terminate or suspend);
  2. you provide false or inaccurate information;
  3. you violate these Membership Terms, the Terms of Service or any other Carrie Fitness rules or agreements then in effect;
  4. you engage in conduct that is a violation of any applicable law or tariff (including, without limitation, copyright and intellectual property laws); or
  5. if you engage in conduct that is threatening, abusive, or harassing to Carrie Fitness employees, agents, or other Carrie Fitness users, including, for example, making threats to physically harm or damage property.

If Carrie Fitness determines, in its sole discretion, that your Membership is being accessed in a commercial setting or is for commercial use, Carrie Fitness reserves the right to terminate or suspend your Membership at any time by writing to you at the email address associated with your Membership.

If we terminate or suspend your Membership or access to the Carrie Fitness Site or App, your license to use any software or content provided in connection with the Membership is also terminated or suspended (as applicable). If your Membership or access to the Carrie Fitness Site or App is terminated, Carrie Fitness has the right to immediately delete all data, files, and other information stored in or for your account without further notice. You must pay all charges up to and including the date of termination. Should you wish to resume your Membership after any suspension, a restoration of service fee may apply. This fee includes all past-due unpaid charges and other fees.

Payment

Amount to be Charged. Membership Holders agree to pay the applicable Membership Fees for the applicable Membership Tier and Cycle when they purchase their Membership (plus any applicable taxes and other charges). If the amount to be charged varies from the amount pre-authorized (other than due to the imposition of, or change in, applicable sales tax), Membership Holders have the right to receive, and we will provide, notice of the amount to be charged and the date of the charge before the scheduled date of the transaction, unless applicable law requires Membership Holders to consent to the change in price expressly. Any agreement you have with your payment provider governs your use of your specified payment method. You agree that we may accumulate charges incurred and submit them as one or more aggregate charges during or at the end of each billing cycle. Your failure to terminate and/or continued use of your Membership (including continued use of your Membership following the expiration of an Activation Code) reaffirms that we are authorized to charge you and you are obligated to pay us for that Membership. We may submit those charges for payment, and you will be responsible for such charges. This does not waive our right to seek payment directly from you.

Billing Authorization. You may be asked to provide a payment method (such as a credit, charge, or debit card number) that we accept, along with other payment information, to activate your Membership, including Memberships paid for with an Activation Code, along with other payment information. You represent and warrant that you have the legal right to use all payment method(s) you provide us. Your authorizations in this section also apply to our payment processors and other companies acting as billing agents for us. You hereby authorize us to charge your specified payment method on a monthly or annual basis, as applicable, in line with your Membership Cycle and Tier, in advance, for your Membership(s) and/or to place a hold on your payment method for any unpaid charges for your Membership(s). You authorize the issuer of your selected payment method to pay any amounts described herein without requiring a signed receipt. You agree that these Membership Terms shall be accepted as authorization to the issuer of the payment method to pay any amounts described herein without requiring a signed receipt from you. You authorize us to continue to attempt to charge and/or place holds for all sums described herein, or any portion thereof, to your payment method until such amounts are paid in full. You agree to provide updated payment information upon request, and at any time, the information you previously provided is no longer valid. You acknowledge and agree that neither Carrie Fitness nor any Carrie Fitness representative or agent will have any liability whatsoever for any insufficient funds or other charges incurred by you due to attempts to charge and/or place holds on your specified payment method as contemplated by these Membership Terms. If you provide a debit card number instead of a credit card number, you authorize all charges described herein to be applied to such debit card unless and until you provide a credit card number.

Third-Party Payment Processors. You agree to pay us, through our payment processors, all charges at the prices then in effect for any purchase in accordance with the applicable payment terms presented to you at the time of purchase. You agree to make payment using the payment method you provide when you set up your account. We reserve the right to correct or instruct our payment processors to correct any errors or mistakes, even if payment has already been requested or received.

Bill Inquiries and Refunds. If you believe you have been billed in error for a Membership, please notify us within 30 days of the billing date by contacting us at the below contact information. Carrie Fitness will not issue refunds or credits after the expiration of this 30-day period, except where required by applicable law.
